LUXEMBOURG: SPECULATION IS BACK FOR COMMERCIAL SUBLETTING!
Since 2018, Luxembourg law no longer allows tenants of a commercial lease to sublet their premises while generating a profit.
It was common, in Luxembourg City for example, for commercial companies to sublet up to 3 times the price paid to the lessor.
However, in a decision of 23rd December 2022, the Luxembourg Constitutional Court challenged this principle prohibiting such speculation.
